This Private Policy is an integral part of the Terms of Use of Ukraine’s Ambience Project (henceforward the “Project”, “We”, “Us”). It applies to the information collected by the Project through our website https://ambience.in.ua (the Website). We want You (henceforward “User”, “Visitor”, “Customer”) to use the Website with complete confidence. We have created this Privacy Policy to demonstrate our firm commitment to User’s privacy and security. 

Our Privacy Policy describes how and why We collect, store, use, and/or share (‘process’) your information when You visit our Website and use our services (the “Services”). Reading this Privacy Policy will help You understand your privacy rights and choices regarding the use, access, and correction of your personal information. We may update our Privacy Policy from time to time. The updated version will be indicated by an updated ‘Revised’ date and the updated version will be effective as soon as it is accessible. Personal Data Collection Purpose

We are committed to making our “Services” as useful as possible. In order to deliver and improve our Services, We need to collect and use some personal data. We process personal information of our Users to provide, administer, and improve our Services, to communicate with Users, to enhance security and prevent fraud, and to comply with law. Collected Information Categories

Personal information provided by User

We collect personal information that User voluntarily provides to Us when he/she/it expresses an interest in obtaining information about Us or our Services, registers on the Services, or otherwise when User contacts Us. User’s personal information that We collect include name(s), phone number, email address, password(s), and some payment data when User purchases our fee-based informational services (for instance, your payment instrument number). All personal information that User provides to Us must be true, complete, and accurate, and User must notify Us of any changes to such personal information. This information is not shared with third parties. Please note that We do not process sensitive information and that all payment data is stored by the payment service provider(s). 

Information collected automatically 

We may automatically collect certain information when User visits, uses, or navigates the Services. This information does not reveal User’s specific identity (like his/her/its name or contact information) but may include device and usage information, such as User’s IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when he/she/it uses our Services, and other technical information. We will use this information, which does not identify individual Users, to administer the Website, to maintain the security and operation of our Services, and to analyse trends, track Users’ movements around the Website and gather demographic information about our User base as a whole to improve our Services. We will not link this automatically collected data to personally identifiable information.

In particular, please be aware that Website is using Google’s reCAPTCHA v3 (Completely Automated Public Turing test to tell Computers and Humans Apart) to determine if the User is a bot – or human and to protect Website from spam and abuse. 

Cookies and tracking technologies

Like many other businesses We may use cookies or similar technologies to administer the Website, analyse trends, track Users’ movements around the Website, etc. Cookies are text files containing small amounts of information, which User’s computer, tablet or mobile device downloads when he/she/it visits the Website. Cookies enable the Website’s systems to recognize User’s browser and capture and remember certain information including log and usage data, device data, and location data.  

Log and usage data is service-related, diagnostic, usage, and performance information, which website servers automatically collect (when a user accesses or interacts with the website) and record in log files. Depending on how user interacts with the website, this log data may include his/her/its IP address, device information, browser type, and settings and information about user’s activity on the website (such as the date/time stamps associated with website usage, pages and files viewed, searches, and other user actions and features used), device event information (such as system activity, error reports, and hardware settings).

Device data, i.e. information about the computer, phone, tablet, or other device used to access the website, may include information about his/her/its IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

Location Data, i.e. information about device’s location, can be either precise or imprecise. The amount of information that can be collected depends on the type and settings of the device, which was used to access the website. User can opt out of allowing the website to collect this information either by refusing access to the information or by disabling his/her/its location setting on that device. 

We may use the following types of cookies: (1) required (cookies required to enable core site functionality), (2) functional (cookies used to analyse the website use), and (3) advertising (cookies used by advertising companies to assess your interests). Website’s Users can control the use of cookies at the individual browser level.

When You visit our login page, We will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when You close your browser. When You log in, We will also set up several cookies to save your login information and your screen display choices. Theses cookies last for two weeks. If You select “Remember Me”, your login will persist for two weeks. If You log out of your account, the login cookies will be removed.

Embedded content

Articles on our Website may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if You have visited the other website. If You have an account and are logged in to that website, it may collect data about You, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content.

Responses to Email Inquiries

When User sends an email inquiry to the Project, the return email address will be used to answer the email inquiry that We receive. We will not use the return email address for any other purpose than communication with the User and will not share the return email address with any third party.

Testimonials

We may display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent We may post your testimonial along with your name. If You wish to update or delete your testimonial, please contact us at [email protected].

Links to Third Party Sites

Our Website includes links to third-party websites, online services, or mobile applications and/or may contain advertisements from third parties that are not affiliated with Us and which may link to other websites, services, or applications. Accordingly, We do not make any guarantee regarding any such third parties, and We will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link towards a third-party website, service, or application is made for your convenience and it does not imply an endorsement by Us. 

We cannot guarantee the safety and privacy of data You provide to any third parties. Any data collected by third parties is not covered by this Privacy Policy. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly to respond to your questions.

Our Website also includes social media features, such as the Facebook button, and widgets. These features and widgets may collect your IP address and pages You visited on our Website and may set a cookie to enable proper function of a feature or a widget. Your interactions with these features and widgets will be governed by the privacy policy of the company providing it.

Storing Personal Information

We will only keep your personal information for as long as it is necessary for the purposes set out in our Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). We will retain your information as long as your account is active or it is necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Then, those retention periods will be mandated by law, contract or similar obligation applicable to our business operations; or determined by the need to maintain adequate and accurate business and financial records. No purpose in this Policy will require us keeping your personal information for longer than twelve (12) months after your last visit to our Website or the end of your last subscription period or termination of your account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Transferring Personal Information

Ukraine’s Ambience is a Ukraine-based Project. For Users outside Ukraine, please be aware that any information You provide to Us may be transferred to and processed in Ukraine. By using our Website and providing Us with any information, You consent to this transfer, processing and storage of your information in Ukraine.

Processing the Collected Information

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  1. To facilitate your account creation and authentication and otherwise manage your account; 
  2. To deliver or facilitate delivery of our Services to You;
  3. To respond to your inquiries or provide the requested support; 
  4. To send You administrative information (for instance, changes to our terms and policies, details about our Services);
  5. To fulfil and manage your orders, payments, and refunds made through the Services;
  6. To contact You and request feedback about your use of our Services;
  7. To keep our Services safe and secure;
  8. To identify usage trends; or
  9. To save or protect an individual’s vital interest.

We only process your personal information when We believe it is necessary and We have a valid legal basis to do so under applicable law, like with your consent, to comply with laws, to provide You with Services, to enter into or fulfil our contractual obligations, to protect your rights, or to fulfil our legitimate business interests. 

Usually, We rely on the following legal bases to process Users’ personal information:

  1. Consent – We process User’s personal information if User has given Us permission to use his/her/its personal information for a specific purpose; User can withdraw his/her/its consent at any time; 
  2. Performance of a contract – We process User’s personal information when We believe it is necessary to fulfil our contractual obligations to User;
  3. Legitimate Interests – We process User’s personal information when We believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms, for example, (a) to diagnose problems and/or prevent fraudulent activities and (b) to analyse how our Services are used so We can improve them to engage and retain Users;
  4. Legal Obligations – We process User’s personal information where We believe it is necessary for compliance with our legal obligations, for example, (a) to cooperate with a law enforcement body or regulatory agency, (b) to exercise or defend our legal rights, or (c) disclose User’s information as evidence in litigation in which We are involved;
  5. Vital Interests – We may process User’s personal information where We believe it is necessary to protect User’s vital interests or the vital interests of a third party, for example, situations involving potential threats to the safety of any person.

Disclosing Information to Third Parties

The Project, generally, does not share User’s personal information with third parties. However, We may disclose User’s personal information collected if We have received User’s permission beforehand or in very special circumstances, such as when We believe that such disclosure is required by law or other special cases described below.

Voluntary Customer Surveys

We may periodically conduct both business and individual customer surveys. We encourage Users to participate in these surveys because they provide Us with important information that may help Us improve the Services, which we offer. Your personal information and responses will remain strictly confidential, even if the survey is conducted by a third party (that company will be prohibited from using Users’ personal information for any other purpose). 

Participation in our customer surveys will be voluntary. We will not share the personal information You provide through a contest or survey with other third parties unless We give You prior notice and choice. We will use the aggregated information to improve the quality of our Services, and to develop new Services and/or products. This aggregated, non-personal information may be shared with third parties.

Project’s Partners

We may be requested to share your personal information with companies that provide security, fraud detection and/or other services, which are essential for conducting our business activities. These companies will be authorised to use your personal information only as necessary to provide these services to Us.

We may share your data with other service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. The pool of third parties we may share personal information with includes: (a) website hosting service providers, (b) user account registration & authentication services, (c) data storage service providers, (d) payment data processors, (e) analytics services. We also may need to share your personal information in connection with, or during negotiations of, any merger, sale of assets, financing, or acquisition of all or a portion of our business to another company.

The Project reserves the right to disclose personal information about our Users, or information regarding their use of the Services, in those cases when We believe that it is reasonable to do so, including: (a) to satisfy laws, regulations, or governmental or legal requests for such information; (b) to disclose information that is necessary to identify, contact, or bring legal action against someone who may be violating our Terms of Use; or (c) to protect the Project and its Users. 

We will cooperate with the government and law enforcement officials and private parties that We, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (such as subpoena requests), to protect our property and rights or the property and rights of a third party, to protect the safety of the public or any person, or to prevent or stop the activity, which We consider to be illegal or unethical. To the extent We are legally permitted to do so, We will take reasonable steps to notify You in the event that We are required to provide your personal information to third parties as part of a legal process.

Reviewing, Updating, or Deleting Your Personal Data

Depending on the circumstances, you have a right to know:

  1. whether we collect and use your personal information;
  2. the purposes for which the collected personal information is used;
  3. the categories of personal information that we collect;
  4. whether we sell or disclose your personal information to third parties;
  5. the business or commercial purpose for collecting or selling personal information;
  6. the categories of personal information that we may sell or disclose for a business purpose; and
  7. the categories of third parties to whom the personal information may be sold or disclosed for a business purpose.

Based on the applicable laws of your country, You may have the right to see the personal information that We collect from You, change that information, or delete it. To review or change the information in your account or terminate your account, You can Log in to your user account settings and update information there. You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information. You can also ask for the deletion of your personal information. If you ask Us to delete your personal information, We will respect your request and delete your personal information, subject to our compliance requirements resulting from a legal obligation or any processing that may be required to protect against illegal activities. Besides We may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Upon receiving your request, We will need to verify your identity to determine whether You are the same person about whom We have the information in our system. We may use personal information provided in your request to verify your identity (authority) to make the request. To the extent possible, We will avoid requesting additional personal information from You for the purposes of verification. However, if We cannot verify your identity from the information already maintained by Us, We may request that You provide additional personal information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you. 

Storing and Securing Personal Data

The security of your personal information is important to Us. We have implemented appropriate and reasonable technical and organisational security measures designed to protect the security of any personal information We process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be absolutely secure, so We cannot promise or guarantee that hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although We will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. Our services are not targeted to, intended to be consumed by or designed to entice individuals under the age of 18. We do not knowingly solicit data from or market to children under 18 years of age. If We learn that personal information from a User less than 18 years of age has been collected, We will deactivate the account and take reasonable measures to promptly delete such data from our records.
